RESOLUTION 274

(January 16, 2009)

In which the National Social Work Council establishes procedures for requesting the use of the Council 's name and logo. The president of the National Social Work Council , exercising her powers under Council Order 001 (June 22, 2001), Chapter V, Article 10 and Article 11 (a), and

WHEREAS

  1. The National Social Work Council was created by Law 53/1977 (December 23), Article 7.
  2. The National Social Work Council has a duty to protect its organizational image.
  3. The name and logo of the National Social Work Council have been used indiscriminately, and without prior authorization
  4. The National Social Work Council will indicate the procedure for requesting authorization to use the name and logo of the Council, and will inform the academic community, the professional bodies and Social Workers in general on this point.

IT IS RESOLVED

Article 1. The compound distinctive sign which is the property of the National Social Work Council is the following:

Name and logo in bronze-blue Times New Roman lettering. The name stands to the right of the logo on two horizontal lines, as shown here:

Logo: Figures of 12 people with their hands and feet joined forming a circle inside, with the heads pointing outwards.

The National Social Work Council is the owner of rights over the distinctive sign, and is the only body able to grant authorizations for its use.

Article 2. The use of the name or distinctive logo of the National Social Work Council is prohibited, without prior authorization, in "publicity, publications, commercial documents all written or oral communications, and independently of the means of communication employed" (Article 156, Andean Decision 486/2000), nor may it be suppressed or modified, or in general used, if use falls under any of the causes given in Articles 155-158 of Andean Decision 486; which represents the unfair use of the name and logo of the National Social Work Council

Article 3. For this purpose, the supranational norms of Andean Decision 486, in harmony with those of the Colombian Commercial Code, Civil Code, Administrative Disputes Code, Criminal Code and Criminal Procedure Code, will apply.

Article 4. Should the rights mentioned be breached, the National Social Work Council will take appropriate action before the competent national authorities.

Article 5. The National Social Work Council will also make a criminal denunciation should any of the offences defined in Article 326 of the Criminal Code be committed, in relation to the fraudulent use of industrial property rights.

Article 6. Procedure for authorization of the use of the name-logo of the National Social Work Council :

a. Written application, providing arguments, and formally delivered to the Council offices or sent by certified mail.

b. The request must indicate when, where and in what medium the name and logo of the Council will be used

c. The request must specify, if the medium is printed, whether this will be in color or black and white.

d. The application must be presented to the Council at least 45 working days in advance.

e. If the application comes from a corporate entity, it must be signed by the authorized legal representative.

Paragraph. Individuals and corporate persons must request authorization from the National Social Work Council on each occasion that the name or logo is to be used.

Article 7. The study and authorization of the use of the name-logo of the National Social Work Council will be conducted as follows

a. The Council will study the requests for authorization of the use of the name of logo within 15 working days.

b. The Council will give a written reply to the interested party, granting or denying the authorization of the request for the use of the name-logo.

c. The Council will provide the design of the name-logo, in order to avoid changes of lettering, the shape of the logo, or color.

This resolution takes effect from the date of its issue
